Law Against Unfair Competition

The German Law against Unfair Competition (UWG) primarily protects competitors from each other and is established to allow hard, but fair competition. Competition is acknowledged as important factor of a free market economy, but German Unfair Competition law is known as one of the strictest in the world. Many IP infringement cases can and should be supported by claims based on Unfair Competition Law. Unfair Competition Law is characterized by case law so that knowledge about the practise of individual courts and forum shopping can be essential.

VJP offers a range of services with respect to claims under Unfair Competition Law. For example: advising about clients' own allowable advertising in Germany; advising about infringement claims against competitors; and litigation.
